Auto insurance withdrawal period: what time limits?

On the one hand, the withdrawal must take place within 14 days after the date of the conclusion of the contract or the date of receipt by the insured of the information on the conditions of the contract, if this date is later than the day of the conclusion of the contract. .
On the other hand, be aware that we can only withdraw contracts signed remotely (via the internet or by phone) or in response to direct mail or door-to-door door-to-door sales. It is therefore impossible to withdraw from contracts concluded in an agency. It should also be noted that when the withdrawal is possible, it is not necessary to justify it for any reason.
What is the procedure to follow to retract your auto insurance legally?
To withdraw from an auto insurance contract, simply send a registered letter to the insurer. This withdrawal request must contain several elements:
The references and the date of the contract;
A request for withdrawal;
A reminder of articles L.120-20-12 of the Consumer Code and L.112-9 of the Insurance Code;
A statement that says that your vehicle has not suffered any accident from the date of conclusion of the contract to the date of withdrawal.
You can attach a copy of your insurance contract to your request. If you have already paid all of your auto insurance premiums, your insurer will reimburse you within 30 days of your withdrawal. The sum corresponding to the number of days during the vehicle will have been insured will be deducted from the reimbursement.
Inability to withdraw from your auto insurance contract
There are situations where it is not possible to revoke auto insurance. Article L.121-20-2 of the Consumer Code specifies that: "the right of withdrawal cannot be exercised for contracts for the supply of services whose execution began before the end of the 7-day period". In other words, if your auto insurance contract took effect within 7 days of signing it, you will no longer be able to suspend it: therefore, withdrawal cannot be made.
Apart from that, be aware that even after the withdrawal periods, it is still possible to terminate your auto insurance contract. To do this :
You can invoke a reason for termination: moving, sale of the vehicle, theft of the vehicle;
You can take advantage of the system established by the Hamon law. This system provides that after one year of subscription, the insured will be able to terminate his contract at any time.
