Definition of auto insurance

In France, to drive legally, your vehicle must be insured. It allows you to get away with it in the event of material damage or bodily injury caused to a third party by the driver or passing by in an accident.

Even if the auto insurance contract is a contract that we often deal with on a daily basis, it has its own characteristics. Overview of the auto insurance contract.

Auto insurance: a legal obligation

Since the law of February 27, 1958 (taken over by the Insurance Code in its article L211-1), car insurance is compulsory. This law obliges all owners to insure their motor vehicles traveling on public roads. This obligation remains whether the vehicle is intended for private use or for professional use.

It should be noted that only the civil liability guarantee or third party guarantee is compulsory for auto insurance. This warranty only provides compensation for accidents caused by the fault of the driver or his passengers for bodily injury suffered by a pedestrian or by the passenger of another vehicle.

It also covers damage caused to other vehicles, or to any other movable or immovable property. Because of these limited warranties, the third party warranty is the cheapest insurance policy.

Failure to comply with the insurance obligation constitutes an offense which can be punished with a fine (3,750 euros), a license suspension (or a license cancellation with a ban on re-passing it for 3 years), a sentence of community service, as well as an impoundment.

Possible guarantees

In addition to the compulsory liability coverage, an auto insurance contract can offer other more or less extensive guarantees.

The improved third

The enhanced third party insurance contract is a third party contract, but comes with a few additional and optional options. Some of the most common options include:

Collision damage coverage: it applies in the event of a collision with a pedestrian, an animal whose owner is identified or another vehicle. In most cases, this guarantee will not apply if the driver has consumed drugs or has a blood alcohol level higher than the authorized limit;
The theft and fire cover: it allows compensation equal to the value of the vehicle on the day of the accident or to a value defined in the insurance contract;

Glass breakage guarantee: it covers damage to the windshield, side windows, rear windows as well as headlight optical units and mirrors;
Guarantees for non-standard accessories: in the majority of contracts, non-standard accessories such as the telephone will only be guaranteed when the subscriber has declared them at the time of subscription.
All-risk insurance

All-risk auto insurance contracts offer the most extensive guarantees since they give the right to all possible options. This insurance guarantees full compensation for the policyholder and his vehicle, but also for the third party who has suffered damage in 2 cases:

When one is declared responsible for the incident;
When there is no designated official (an animal crossing suddenly causes a driver to change the path of his car and causes a collision with another vehicle).
Comprehensive automobile insurance is primarily intended for heavy riders (the risks of having an accident are higher than average). It’s also the perfect choice if you own a new or premium car.

Obviously, comprehensive insurance contracts are more expensive than contracts with lower guarantees.

Cost and price of auto insurance

The different options chosen vary the cost of insurance in addition to the following 2 elements:

Franchise

When settling a claim, the deductible corresponds to the sum that the insured must pay if he is responsible for the claim or if there is no designated person responsible. As a general rule, the higher the insurance premium, the lower the deductible.
