You dispute a transaction appearing on your account statement

Always check your account statements regularly. Indeed, your silence, after receipt of the statement, has the value of tacit approval, according to banking practice. If you do not agree with the amount of the bank charges, the bank charges taken or the count of the value dates, quickly dispute with your banker. Preferably do so within the time period shown on your statements, recalling the references of your account. This period varies according to the types of operations and can go up to thirteen months for the dispute of a transfer, a direct debit or a payment by bank card.

If your bank has committed a fault in carrying out a transaction (a clerical error, for example), it cannot be exonerated from its liability by applying the short time limit for complaints shown on account statements. The action for rectification may be initiated within five years in application of Article L. 110-4 of the Commercial Code, which stipulates that “the obligations arising from their trade between traders or between traders and non-traders are prescribed by five years if they are not subject to shorter special prescriptions ”.

On reading my last bank statement, dated (…), I noticed an error in the amount debited from my account in execution of the transfer (reference number) made in favor of (name of the beneficiary). The exact amount of this transaction was (…) euros, as evidenced by the transfer order of which I am sending you a copy attached.

I ask you to credit my account as soon as possible with the amount corresponding to the difference wrongly debited.

Please accept, Madam, Sir, the expression of my best regards.
