You have been deceived about the real condition of the vehicle you have just bought used

 

You have just bought a used car from a private individual by means of a classified ad indicating that it is in good condition. However, after the transaction, your mechanic tells you that this vehicle has been seriously damaged or that the meter has been tampered with, which the seller did not notify you. You have been deceived and you can file a complaint.

 

The act of deceiving or attempting to deceive the buyer on the essential characteristics of the car constitutes fraud (article L. 213-1 of the Consumer Code). Any seller is bound by a duty of information or information towards the buyer and must spontaneously indicate to him the qualities and defects of the vehicle. He must neither lie nor try to deceive the buyer.

 

To establish a violation of the regulations on price advertising, fraud or a deceptive commercial practice, contact a departmental directorate for the protection of populations ( DDPP or DDCSPP ) in your department or that of the seller if it is different.

(2nd case) I ask you to take this car back and reimburse me the amount I paid you, as well as all the costs that your fraud caused me.

 

In case of impossibility of amicable agreement, I will be forced (e) to file a complaint for deception.
